Why is overbooking legal?

Short answerOverbooking is generally a business practice, not an offense by itself, because accepting more requests than capacity is a gamble the business takes on its own risk. What matters is what you promised, what you disclosed, and what you owe the customer if you cannot deliver. Rules vary by industry and state.

The explanation

In most service work, a booking is a promise about a time. If the business makes that promise and fails, the issue is usually contractual or about fair dealing, not a special ban on overbooking. Some regulated industries have their own rules, such as airlines, which is why that example comes up.

For a plumber or a cleaner, the practical question is whether the customer was told the truth. A stated arrival window, a clear cancellation policy and a plain note that jobs may run late set expectations. A hidden overlap does the opposite.
