Can a customer cancel a contract?

Process: Cancellations and no-shows. Reviewed 2026-10-07.

Short answerOften yes, but it depends on what your contract says and on law that applies to the sale. The FTC's cooling-off rule gives buyers three business days to cancel certain sales signed at their home or away from the seller's permanent place of business [1]. State rules vary, so check yours.

The explanation

Start with your own terms. A service contract should say how a customer can cancel, how much notice is required and what fees apply for late cancellation. If the contract is silent, you have less to point to when a customer backs out.

Then check the rules that sit above your contract. The FTC page on the cooling-off rule describes a right to cancel within three business days for covered sales made at the buyer's home or another location that is not the seller's permanent place of business, and a requirement that sellers give notice of the right [1]. Some states have their own rules for home improvement and other sales.

If you sell at customer homes, build the notice into your paperwork and keep proof that you provided it. When a customer cancels, respond in writing with the date received, what you will refund and when. Ask a local lawyer to review your agreement if you handle larger projects.

What to watch for

  • Assuming your contract overrides rules that apply by law.
  • Collecting a deposit and keeping it after a valid cancellation.
