Is a signed estimate a contract?

Short answerA signed estimate can function as a contract when it states the scope of work, the price and the terms, and the customer accepts it in a way that can be proven. A rough number the customer only glanced at is weaker. Rules vary by state and by project size, so a lawyer should review your template.

The explanation

What turns a quote into an agreement is clarity and acceptance. The document should list what you will do, what is excluded, the price and how it can change, the payment terms and the start window. The customer should sign or accept it online, with a date.

An estimate is, by name, an educated guess. If your document says the final price may vary, say by how much and who approves changes. Otherwise customers read it as a fixed price and disputes follow. A change order process handles scope that grows.

Keep every signed copy with the customer record. For home sales, remember that cancellation rights may apply, and some states require specific language for home improvement contracts. Do not rely on an internet template without checking your state. A short review by a local lawyer is cheap compared with one lost dispute.
